Popular 'gut-healthy' soda brand settles lawsuit: See if you qualify for cash

If you’ve ever purchased the popular sparkling prebiotic drink Poppi, you may be eligible to receive a payment through a recent $8.9 million class action lawsuit. A lawsuit filed against Poppi’s former owners, VNGK Beverage, LLC, in the Northern District of California in May 2024 claims the beverages were improperly marketed and labeled as “gut healthy” — possibly leading consumers to purchase the product or pay more for the product based on that claim — but says its claimed benefits weren’t backed by scientific evidence. Although a settlement has been reached, the former owner has denied making any misrepresentations, according to the settlement website.

Am I eligible for a settlement payment?

Possibly.

If you purchased any flavor or package size of Poppi drinks between Jan. 23, 2020 and July 18, 2025, you could be eligible to receive a payment, the settlement website says.

How do I file a claim?

If you’ve received an email notice, you can file an online claim using the Claim ID and PIN provided in the email by visiting poppisettlement.com/. If you don’t have either of those, you can still submit an online claim.

You can also send in a paper claim through the mail or choose to opt out or object to the settlement.

When is the deadline to file a claim?

If you want to file a claim, you’ll have to do so by Sept. 16, 2025.

How much money will I get through the settlement?

According to the claims website, eligible consumers can receive cash back depending on the amount of Poppi products they bought. If you have proof of purchase, you could receive the following amounts:

  • Up to $0.75 per single can

  • $3 per four-pack

  • $6 per eight-pack

  • $9 per 12- or 15-pack

Without proof of purchase, you’ll only be eligible to receive up to $16 and the payment amounts may change depending on how many claims are approved and how much of the settlement fund is used for other costs.

When will my payment be sent?

Not until at least the beginning of 2026.

There’s a final approval hearing currently scheduled for Nov. 20, 2025 to decide whether the settlement will be approved. From there, the decision may be appealed, but if not, the payments will be distributed within 90 days after the settlement is no longer subject to appeal or review.
